Separation can help you transition to divorce

Many couples that are married but unhappy with their relationship take the immediate step of filing for divorce. This can be a the right move for many, but some should consider the benefits of legal separation. This is an uncommon route for unhappy couples, but it can really behoove those couples to take this route if they are unsure about the finality of a divorce.

Legal separation is a court order which keeps the spouses married, but they live separately and they will also live under rules that are similar to a divorce. Matters such as property division, child custody and even separation maintenance (effectively spousal support during the separation) can be addressed when a couple decides to separate.

The separation can be used as a transitional period, with the couple eventually deciding to divorce. Or it could simply be used as a break, where the spouses consider their lives and/or think through some personal or financial issues that they are having as a couple. If after the separation they decide that staying together is the right thing to do, then you can transition out of the separation. If a divorce or something more permanent is necessary, then a permanent separation or divorce can be achieved.
